WALA nang immunity mula sa mga kasong kriminal si dating Pangulong Rodrigo Duterte dahil tapos na ang kanyang termino.
“Ang immunity ng pangulo ay only during his term at walang immunity ang past president,” ayon kay Justice Undersecretary Jesse Andres sa panayam sa radyo.
Binalaan din ni Andres si Duterte na maaaring may legal na pananagutan ang panawagan nitong pakikialam ng militar sa civil governance. Ayon sa kanya, ang ganitong mga pahayag ay maaaring ituring na inciting to sedition batay sa Revised Penal Code.
“Unang-una po, walang role ang military sa civil governance. Ayon po sa ating Revised Penal Code, punishable po ‘yan na nag-aalis kayo ng suporta sa duly constituted authorities. Inciting to sedition po ‘yan kapag nanghihikayat kayo ng ibang tao, lalo na ang militar,” dagdag niya.
Pinuna rin ni Usec. Andres ang mga pahayag ni Duterte kaugnay sa sinasabing “fractured governance” at ang panawagan nitong pumasok ang militar upang ayusin umano ito.
Iginiit niyang walang ganitong konsepto sa Saligang Batas at walang batayan sa batas ang ganitong pananaw.
“Nagsasalita naman ang dating Pangulong Duterte at mayroon siyang binabanggit na fractured governance. Hindi ko po alam kung ano ibig sabihin ng fractured governance; walang ganoong salita sa Konstitusyon, wala sa batas,” ani Andres.
Dagdag pa niya, isang malaking insulto sa burukrasya ang alegasyong ito, lalo’t tuloy-tuloy ang pagbibigay-serbisyo ng gobyerno sa mamamayan.
“Ang public hospitals are there helping, DSWD, social work is doing its work everyday, civil courts po ay bukas. Lahat ng pamahalaan ng gobyerno na tumutulong at nagde-deliver ng serbisyo. Wala pong humihintong fractured governance,” paliwanag niya.
Patuloy na binabantayan ng DOJ ang mga pahayag at kilos ni dating Pangulong Duterte, kasabay ng panawagang manatiling nakatuon ang lahat sa pagsunod sa batas.
